Evolv+ Terms of Use

1. Acceptance of Terms
By downloading, installing, or using the Evolv+ mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Evolv+.
2. Eligibility & Registration
You must be at least 13 years of age to use Evolv+. If you are under 18, you represent that you have your parent or guardian’s permission. To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Subscriptions & Billing
Evolv+ offers premium features via auto-renewing subscriptions. Payments are processed through your Apple App Store account. Your subscription will automatically renew unless turned off in your App Store account settings at least 24 hours before the end of the current period. Current subscription prices are displayed within the App.
4. Free Trials & Cancellations
If we offer a free trial, your subscription will automatically convert to a paid subscription at the end of the trial period unless cancelled. All cancellations and refund requests must be managed through the Apple App Store according to Apple’s refund policies.
5. Health & Fitness Disclaimer
IMPORTANT: Evolv+ provides fitness, lifestyle, and habit-tracking information for educational purposes only. It is not medical advice. Always consult with a qualified healthcare professional before beginning any new exercise or nutrition program. Your results are not guaranteed and will vary based on individual effort and circumstances.
6. License & Prohibited Uses
We grant you a personal, non-exclusive, non-transferable license to use the App for non-commercial purposes. You agree not to: (a) reverse engineer or attempt to extract source code; (b) use the App for any illegal activity; (c) bypass or attempt to bypass any security measures of the App.
7. Limitation of Liability
To the maximum extent permitted by law, Evolv+ shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the App. We do not guarantee that the App will be error-free or uninterrupted.
8. Indemnification
You agree to indemnify and hold Evolv+ harmless from any claims, damages, or expenses (including legal fees) arising from your use of the App or your violation of these Terms.
9. Termination
We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Evolv+ is headquartered, without regard to its conflict of law principles.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the App after changes are posted constitutes your acceptance.
